Justice Minister Catalin Predoiu: EC experts made no predictions on the future country report

Romanian Justice Minister Catalin Predoiu on December 11 said the experts of the European Commission (EC) have concluded their mission in Bucharest, but they made no predictions on the future EC monitoring report relating to Romania.
 
“I wish to underscore the fact that no predictions or assessments were made on the future country report, but all technical aspects relating to the reform were tackled in detail, as in the spring mission”, Predoiu said.
The minister added there had been debated the need to continue making headway with the 3rd benchmark, irrespective of the political situation and context, as we cannot talk about completed examination works of the CE without the fulfillment of this objective, namely the fight against highlevel corruption.
 
The talks with the EC representatives focused on each objective in turn, from the ones relating to the Ministry of Justice (MJ) to those on the agenda of other institutions, Predoiu pointed out.
 
“We have discussed a relative and foreseeable schedule for the approval of the Codes by the Parliament and their implementation. I have stressed the fact that an impact study is to be carried out in the next two years regarding the codes’ implementation and their effects on the legal system, as well as the assessment of the financing costs necessary for the preparation of the legal system in view of implementing these four codes”, Predoiu explained.
 
The Justice Minister pointed out the fact that the human resources strategy had also been under debate, which could be completed only after the codes were enacted by the Parliament.
Another topic related to the need for the magistrates growing more responsible in the performance of their duties, as well as in the trial procedure and the legal investigations.
 
An agreement has been reached with the experts on some progress made by the Ministry of Justice and the outlook for the overall mechanism, he underscored.
Predoiu said similar talks had been held with all the other institutions involved in the mechanism, with each of them having understood what its mission is in the coming period. He assured the experts of the cooperation with such institutions, saying he will continue to collaborate with the Superior Council of Magistracy (CSM) and the Public Ministry.
 
“However, I have emphasized the fact that we cannot act as the guardian of the National Integrity Agency (ANI) and that this agency should assume responsibility for its actions and prove its efficiency and usefulness according to the limits determined under the law”, the minister said.
Predoiu admitted talks had also been held about Parliament’s intention to modify the law on the appointment of prosecutors in management positions, thus reiterating the stance of the Ministry against this procedure.
 
“We disapprove of this modification procedure not only due to opportunist reasons within the mechanism. I think it is too soon for this procedure to become the responsibility of the CSM.
I believe this measure can be debated and promoted only when the entire Romanian legal system can prove it is mature enough to relieve the people carrying out such procedures of any suspicion”, the minister said.
The experts were mainly interested in the harmonization of the laws, the publication of the sentences on the websites of the courts, but also in the legal examination of the CSM.
