DNA report: Criminal cases are postponed

The National Anti-Corruption Directorate (DNA) reveals in its 2008 activity report released on Friday by chief prosecutor Daniel Morar that criminal trials should be curtailed because there are important cases, also in terms of the capacity of persons involved, that have been delayed. Speed of criminal trials involving cases from the past was good, the report says, but speed of cases under ongoing criminal investigations or that have reached courts is not that good.
 
The DNA report reveals that in cases deemed important because of the capacity of the defendants, the number of defendant or the magnitude of the criminal offence involved, the length of the criminal trial is significantly prolonged. There are some cases on the court's log on which no decision on the merits has been pronounced three years after they were opened, and instances in which the indictment was not read more than one year after being drawn up.
 
DNA argues that repealing the provisions concerning the suspension of criminal trial pending the resolution by the Constitutional Court of unconstitutional objections raised in the case in question, as well as approving the new draft of the Code of Criminal Procedure providing for a limited time span for objections, and other solutions for curtailing the time for criminal investigations and court trials are all necessary.
