State Secretary with the Ministry of Foreign Affairs (MAE) Bogdan Aurescu, Romania's Agent at the International Court of Justice (ICJ) said on Thursday that the solution of the Hague -based court is better than any compromise formula that might have been obtained by negotiations between the two sides.
At the conference called 'Decision no. 10 of the International Court of Justice – Maritime delimitation in the Black Sea. Presentation of the decision,' organized by the Nicolae Titulescu Foundation, Aurescu resumed the arguments of the Romanian side that led to a decision favorable to Romania in the case against Ukraine.
Aurescu stressed that over 1967-1987, Romania had ten rounds of negotiations with the USSR on this issue. The best offer of the USSR occured in 1987, at the last round of talks, when through the proposed course, the Soviet side would have obtained 4,000 sq. km. of continental shelf, an exclusive economic area.
Subsequently, Ukraine increased its claims, said Aurescu. Many efforts have been deployed with a view to trying to obtain through negotiations one result or the other, but Ukraine's claim, throughout the negotiations with Romania of after 1995 and then after 1998, has always remained unchanged, accounting for 200 percent compared to the maximal claim which the USSR had over 1967- 1987along the negotiations,' said Romania's Agent before the ICJ.
By the solution given by the International Court of Justice on February 3, Ukraine received further 2,5000 square km. It is obvious this formula of solving the litigation at the Hague -based court is the best formula and this is the best result we can get,' said Aurescu.
Aurescu emphasized that the arguments of the Romanian side were not dependent one of another, but they were autonomous.
The State Secretary with the Romanian Ministry of Foreign Affairs congratulated his team on the result obtained in the Hague and underscored the necessity for Romanian experts at the school of international law. The event organized on Thursday was part of the range of conferences initiated by President of the Titulescu Foundation, Adrian Nastase.
In the end, he emphasized that the bilateral negotiations are the natural solution in the case of a conflict between two neighbors , but that a compromise solution is very hard to accept when territorial conflicts occur.
In the decision ruled on Febr. 3, 2009, the International Court of Justice in the Hague recognized Romania's sovereign jurisdiction on a territory of 9,700 sq.km. out of the area of Black Sea continental shelf of 12,000 sq.km. which was subject to the litigation with Ukraine. At the same time, the court decided that the Serpent Island cannot be considered basic point , therefore, it cannot play any role the establishment of the delimitation line of the continental shelf and of exclusive economic areas. The case at the International Court of Justice started on September 2004 at Romania's request.
