Gov’t to assume responsibility for codes next Monday

The Standing Bureaus of the two chambers of Parliament decided at a joint meeting on Monday that the Government would assume responsibility for the draft Penal Code and Civil Code next Monday, in two joint sittings of the Deputies’ Chamber and the Senate.

‘Today the joint Standing Bureaus noted Prime Minister Emil Boc’s request and the Government’s wish to assume responsibility for the Penal Code and Civil Code separately and decided that Prime Minister Boc will be able to assume responsibility for the two draft acts in two joint sittings of Parliament on Monday’, Senate inspector Ioan Chelaru said.

He explained that the deputies and senators could put forward amendments by Thursday.

‘From the moment the amendments are filed, the Government has the possibility to debate the amendments by Monday in order to approve or reject them. There might be an extraordinary meeting of the Government on Sunday or early Monday’, Chelaru said.

A no-confidence motion can be tabled in three days after the Government takes responsibility, he added.
‘Should no such no-confidence motion be tabled, then each code will be deemed approved by the classic procedure on adopting a law.

However, if such a motion is tabled, the Standing Bureaus in a special meeting will set the date of a new joint sitting of the two chambers to unveil the no- confidence motion, in five days since such motion is tabled.

There will be another three-day deadline to debate the no-confidence motion after it is presented to the joint plenary sitting’, the senator explained.

If the vote of censure passes, the two draft codes will be rejected and the Government will fall, Che laru stressed.

In case the no-confidence motion fails to get the required votes, the two draft codes would be adopted and be submitted the Government’s General Secretariat.

‘The draft acts will be sent to the Romanian President for signing into law two days after being submitted at the Government’s General Secretariat’, Chelaru explained.
