The minister of Justice and Civil Liberties Catalin Predoiu proposed Codruta Kovesi for a new term-in-office, however, the Supreme Council of Magistracy gave a negative endorsement. According to the procedure, the appointment of the prosecutor general is made by Romania’s president at the proposal of the justice minister with the approval of the Supreme Council of Magistracy.
According to legal procedures, the term-in-office is of three years and it may be renewed a single time. Laura Codruta Kovesi was appointed prosecutor general of the Prosecutor’s Office with the High Court of Cassation and Justice on October 2, 2006 by decree signed by President Traian Basescu.
The negative endorsement by the Supreme Council of Magistracy was given with a majority of 5 to 1. Kovesi said at the time that she was expecting an interview focused on technical issues, however, she was asked questions about her critical stands targeting the Supreme Council of Magistracy.
‘I consider that I had a good mandate and that the priorities established when I took office were 100% carried out when they referred to the exclusive attributions of the prosecutor general,’ said Kovesi.
She admitted though that certain problems of the Public Ministry haven’t been solved during her term-in-office because of legislative hindrances and obstructions from other institutions.
