Traian Basescu: In former communist states it is more difficult to explain necessity of data stocking

President Traian Basescu thinks that in the former communist states, it is more difficult to explain to the population the reasons for the stocking of the phone data, for them to be used by the authorities in case of need.

“I want to draw attention to you in connection with how far we can go with the IT in the private life of people. For instance, in Romania, following the recommendations of the European Union, adopted has been a law on the stocking of phone calls. The law was rejected by the Constitutional Court, and in Romania, there was an extremely comprehensive debate on this issue.

Probably, in the former communist countries it is much more difficult to explain to the citizens why these data have to be stocked and used by the authorities in case of need,” said the head of state present, on Monday, at the Global Forum “IT&C” and the future of the IT Society,” held at the Parliament Palace.

Basescu said that at the end of a speech delivered at the opening of the forum. The president stressed the idea, explaining, in English, the reasons for the reticence of the population.
Because of the way in which the power was made by the former regime, the Romanians, and I am sure that things are so in all the former communist countries, the feelings of the population connected to the supervision of the private activities are tougher than in other democratic countries, where the confidence of the citizen in the state is higher, is a habit of the everyday life.

In our country the trust in what the state could do with such data is low, because of the experience in the past 50 years. I have made this parenthesis, for giving you a fair approach of this region of the world,” said the head of state.
The Constitutional Court of Romania, CCR, decided on Oct 8, by a majority of vote, that the provisions of Law 298/2008 on the stocking of the phone data are non-constitutional.

The judges of the Constitutional Court admitted in this way the exception of the Committee for Civil Society in a trial against a mobile phone company.
The Committee for the Civil Society sued the mobile phone company, for it to observe its contract clauses regarding the confidentiality of the phone calls.
