CCR: Single pay law assumed by the Gov’t is constitutional

5 noiembrie 2009

Information in English

The single pay law assumed by the joint session of the two chambers of the Romanian Executive is constitutional, the Constitutional Court of Romania (CCR) ruled on Wednesday, Nov 4.

The judges have rejected thus the claims of the National Liberal Party (PNL) regarding the unconstitutionality of the basic law on the single pay in the public system.
‘The basic law on the single pay in the public system is constitutional, for the article 41 paragraph 2 letter 1 of the law claimed to be unconstitutional did not refer to the cases related to which the fundamental law of the state specifically admits one having more than one job’, reads a release of the CCR.

According to the abovementioned source, the Constitutional Court presented its arguments within the decisions waiting to be published in the Official Gazette of Romania, Part I. The Court’s decisions will be final and binding upon all parties and they will be communicated to the Romanian President to be promulgated in compliance with the article 77 paragraph 3 of the Romanian Constitution.
