Legal committee: Dismissed Gov’t may draw up budget

The legal committee of the Chamber of Deputies on Monday drew up a favourable report on the modification of art. 26 of Law 90/200 1 on the organisation and functioning of the Government, so that in exceptional situations, a dismissed government, but still in office until a new cabinet is sworn in, may initiate some draft laws such as the one on the state budget and on social insurance.

Therefore, the committee’s deputies support the introduction of a new paragraph to the article 26 of the law which stipulates that a government whose term-in-office ceased, but which is still in office until the takeover of attributions by the next government may initiate draft laws on the ratification of international treaties and on draft budgets and social insurance.

The recitals read that the legislative modification is necessary considering that neither the state budget nor the budget of social insurance on 2010 have been drawn up and that the Government was dismissed. According to the law, a dismissed Government cannot initiate draft laws, therefore several MPs have initiated the modification.
Initiators of the draft law on the modification of Law 90/2001 are leaders of parliamentary groups of all the parties of the legislative, as well as the leader of the parliamentary group of the national minorities.
