Chairman of the National Council for Resolving Claims Mihai Prisacariu, who attended the event, unveiled the main issues that the Council encountered in its activity in 2009 and he answered the problems raised by the participants with respect to the manner that the claims are resolved, the reasons for filing a claim over the assignment documents that the Council admits, the qualification and selection criteria, specific procedures, the reason for rejecting a bid or for ranking a bid as a non-winner as well as frequent mistakes in drawing up and filing the claims.
‘The public presentation of the results got by the Council in 2009 proves Romania currently has at least a well-defined body on the basis of which it can boost the absorption of the European funds. Thus, in 2009 from 2008 the Council recorded a 41.45 percent rise in the number of filed claims, with the number of the resolved files reaching 9,019, i.e. a 38.39 percent rise.
Such a huge volume of work was done by meeting the legal deadline for a settlement, i.e. an average 19 days’, Prisacariu said. The participants in the debates made such propositions as providing a unified practice as regards claim settlement, enhancing the transparency of the procedure and harmonising the divergences related to interpretation existing between the Council and other relevant public authorities.
AmCham and the National Council for Resolving Claims staged a seminar on the procedure of filing claims to the Council amid the new modifications of the public acquisition laws. AmCham Romania is an apolitical non-profit organisation established in 1993 by U.S. investors.
